Terms, Conditions and Cancellation Policy

CANCELLATIONS AND RESCHEDULING

Due to the nature of Snorkelling and Freediving in Jervis Bay the following policy applies to all of our tours and courses. 

Cancellation or change of date outside 7 days of the tour/course will result in a 25% fee.

Cancellation or change of date within 7 days of the tour /course will result in a 50% fee.

Failure to arrive or change of date/cancellation within 72hrs of departure will result in a full fare forfeiture.

All trips can be subject to change last minute due to circumstances out of our control. In the event that we cancel the tour/ course due to adverse weather conditions, mechanical breakdowns or not meeting the minimum participant numbers required, you will be offered a full refund (not including card/booking processing fee), gift voucher or reschedule to another date.

If you are not contacted about a cancellation, expect your tour/ course to run as planned.

All refunds do not include any currency conversion fees, card processing fees or booking fees charged by third party providers.

WOEBEGONE GETAWAYS

Our current fees for our trips are available on our website. Trip fees do not include airfares or other travel costs (to and from the destination), insurance or taxes.

To secure your spot on all trips, you must pay a non-refundable deposit. This is due to the prepaid nature that we must adhere to at our venues.

Remaining/ final balance (trip cost minus deposit) is due 60 days prior to the start date of the trip.

If you book 60 days or less from the start of the trip, you must pay the full amount at the time of booking.

Payment of the final balance for your trip is to be paid via bank transfer.

Fees for our trips are subject to availability and we reserve the right to withdraw or change our fees for a trip, and to change trip itineraries, at any time prior to the trip occurring.

Woebegone does not offer refunds outside of those listed below. This is due to the prepaid nature that we must adhere to at our venues.

Your deposit is non-refundable in all circumstances.

If you cancel 30 days or more prior to the trip, you can receive the full amount paid or a credit, with exclusion of the non-refundable deposit.

If you cancel 30 days or less prior to the trip, you will forfeit all payments made towards the trip. Tickets can be transferable.

If you cannot travel due to COVID-19 border closures or contracting covid-19 you can receive a credit, with exclusion of the non-refundable deposit. Travellers will need to provide evidence in the form of a positive PCR confirmation (i.e. text or email containing travellers name, phone number, date of test, location of test).

Exceptions to our policy cannot be made for any reason, this is why it is imperative to get travel insurance as soon as you have paid the deposit. Please make sure that natural disasters and personal injuries are covered.

All cancellations must be made in writing via email to info@woebegone.com.au; the deposit is non-refundable and is subject to the refund policy – listed above.

Woebegone may cancel the trip if a minimum quota of participants has not been reached within 3 weeks prior to the trip date. We will offer a full refund if we cancel the trip.

Woebegone shall not be liable for any failures beyond its control. This covers natural disasters, war, ‘acts of god’, closure of airports, civil strife, accidents or failure to perform by third parties, including suppliers and subcontractors that cause a delay or cancellation of the trip or its services.

Woebegone is not responsible for any expenses incurred in preparation for any cancelled trip, such as airline tickets, loss of work, and/or other costs associated with preparation for your trip. It is imperative to get travel insurance as soon as you have paid the deposit.

OCEAN SCHOOL

All ocean school fees are to be paid up front before commencement of the 8 week term. Lesson one is a trial period with the option to cancel with a refund of the term amount minus $30. Cancellations after lesson one will result in a full forfeit of the term amount as we have very limited spaces.

It is very important that they attend all the classes for safety reasons as they are learning all the important skills to dive in the ocean safely and each class flows into the next.

Ocean school isn’t for everyone. If your child does not enjoy the first class and is not interested in learning to freedive and snorkel at this stage we would recommend contacting us immediately. We have found that if a child doesn’t want to participate or is being forced, they don’t absorb the information and disrupt the class, which can put themselves and the other children in danger. But don’t be disheartened, it might just not be the right time yet, and one class may plant that seed in their mind that could germinate when they are a bit older.

Like anything ocean related, there is an element of risk involved, that being said, we believe that snorkelling is actually quite safe with proper instruction. It is much more dangerous being a passenger in a car.

LIABILITY
Some of our expeditions, tours, courses and getaways may take you to places that are far away from urgent medical care and could be deemed dangerous – including, but not limited to, swimming in the open ocean, diving with sharks, Freediving, scuba diving, whale swimming, and so on. You enter all activities at your own risk. By registering for our expeditions, tours, courses and getaways you are stating that you understand this risk and waive your rights to hold Woebegone Freedive Pty Ltd or any of their staff liable for any harm that may come to you. Additionally you waive the rights of anyone tied to you, your family, or estate to hold us liable. Despite how daunting this sounds, our staff are highly qualified to deal with any emergencies following our established emergency protocols.

 

HEALTH AND FITNESS

Upon making a booking and attending our expeditions, tours or courses, you warrant that:

(a) you are in good medical and physical condition; and

(b) there is no reason, medical or otherwise, why you should not be able to participate.

We reserve the right to refuse you from participation in an upcoming trip (that has not departed), from parts of a trip (that has departed), or related trip activities, without refund, if:

(a) we perceive a reasonable risk of injury to you or any other person due to your participation; or

(b) we perceive that you have an infection, covid-19, contagious illness, physical ailment or open cut or sore; or

(c) we perceive your behaviour to be aggressive, disruptive, antisocial, discriminatory, predatory, illegal or in any way inappropriate to the well-being of other participants, or staff, and the overall trip experience prior, during or after the trip; or

(d) we perceive your behavior to be threatening, or violent.
